1. Price of the service

The prices of each of the services proposed by Tahiti Nui Helicopters are brought to the Customer's attention.

The price invoiced to the customer includes:

  • the costs associated with the helicopter
  • all taxes and duties related to the service
  • the payment by the assistance agents,

Upon prior request, the transfer can be arranged by Tahiti Nui Helicopters and will be charged 3000 XPF (24 €) per person. 

In the case of a specific request for an air service (outside the price list provided), Tahiti Nui Helicopters will produce an estimate respecting all the requests communicated. Under tariff conditions :

  • ENF (less than 2 years) : 0%
  • CHD (2 to less than 12 years) : 85%
  • ADT (12 years and more) : 100%
2. Payment terms

Payment will be made by the Client before the service is provided. If payment is made directly to Tahiti Nui Helicopters' Third Party Partners (Hotels, Tour Operators and Agencies), the Customer will present a duly informed voucher, presenting the exact description of the service to receive. If payment is made directly to Tahiti Nui Helicopters, a receipt from the company will be issued to the Customer.

Concerning the Customer's payments in favour of Tahiti Nui Helicopters, the company will accept:

  • VISA, MASTERCARD, AMEX bank cards
  • Local cheques (French Polynesia) subject to payment made more than 30 days before the service.

Tahiti Nui Helicopters undertakes to provide strictly the service mentioned on the voucher or received 

3. Cancellation conditions

Cancellation by Tahiti Nui Helicopters:

the Pilot will be fully responsible for the operation of his helicopter at all times. If the Pilot, at his own discretion, feels that flight safety is compromised (meteorological and/or technical reasons), he may make the decision at any time to end or refuse to commence his flight. Client cannot make Tahiti Nui Helicopters responsible for direct, indirect or induced damage or costs resulting from termination or refusal to operate a flight.

If the number of passengers booked on a shared flight is insufficient, Tahiti Nui Helicopters will propose to Client to postpone the flight.  If postponing the flight is impossible, Client will have full refund of the cost of the service. 

 

Cancellation by Client:

this may generate the following costs:

  • 7 days > Cancellation > 72H: 10% of service price
  • 72H > Cancellation > 24H: 50% of service price
  • Cancellation < 24H: 100% of service price

 

 

MODIFICATIONS

Any modification by Client may generate the costs as follows:

  • Re. private flights: no cost
  • Re. flights said to be shared flights : Modification < 24H: 100% of service price

However, costs may be cancelled if an expressly contraindicative medical certificate is produced by Client to Tahiti Nui Helicopters.

4. Conditions of carriage

Children under 2 years of age do not have a seat and sit on the lap of a parent, equipped with a seat belt. Children between 2 and 12 years of age may not be seated in the front of the helicopter or in the sliding door seat. Children in this age group must be accompanied by at least one adult in the rear seats.

The potential risks arising from vibrations during helicopter flights justify the refusal to transport pregnant women, unless a medical certificate to this effect is produced. The company declines responsibility if a pregnant woman does not declare her condition before boarding.

5. Force majeure

TAHITI NUI HELICOPTERS shall not be deemed to have breached any of its obligations under these standard terms and conditions nor shall it be liable for any delay, cancellation or damage resulting from force majeure, acts of civil or military authorities, serious or labour disputes, mechanical failures, lack of essential supplies or parts or acts beyond its control, TAHITI NUI HELICOPTERS will, however, if a journey stops before its destination, in whole or in part for such reasons, reimburse the customer for all payments previously received in connection with this journey other than the cost of the transport previously performed and the transport necessary to return the charter flight customers to their original departure airports.

If the customer's journey is completed before its destination and TAHITI NUI HELICOPTERS provides another helicopter to continue the customer's itinerary, the customer will reimburse TAHITI NUI HELICOPTERS for any additional costs compared to the initial offer resulting from the provision of the replacement helicopter.

6. Loss of property or damage

TAHITI NUI HELICOPTERS liability for loss of or damage to property (including, without limitation, luggage and personal effects) shall not exceed $1,000 per passenger.

7. Exclusion of liability - Warranty clause

The liability of Tahiti Nui Helicopters is excluded except in cases of gross negligence. Tahiti Nui Helicopters shall in no event be liable for indirect or consequential damages, costs or liabilities, including attorneys' fees, and in no event shall Tahiti Nui Helicopters uninsured liabilities, whether contractual or for unlawful acts, exceed the amount paid by the customer for the theft in question.

The customer shall indemnify and hold Tahiti Nui Helicopters harmless from any loss, damage or expense incurred by Tahiti Nui Helicopters as a result of acts or omissions of the customer, its employees, agents and guests. In addition, the customer agrees to pay any damages caused to the charter helicopter by the customer, its employees or guests, normal wear and tear being excluded. The same liability and warranty exclusion rules will apply to the owner and operator of the chartered helicopter.

8. Diverse

The illegality or invalidity of any paragraph, clause or provision hereof shall not affect or invalidate the remaining paragraphs or provisions. It is agreed that these standard terms and conditions and the confirmation to which they are attached constitute the entire agreement of the parties with respect to their subject matter. No condition can be changed except by a written document signed by both parties.

9. Applicable law and jurisdiction

These standard terms and conditions and the confirmation to which they are attached are subject to applicable laws, regulations, approvals and concessions. These standard general conditions and the confirmation to which they are annexed are governed by the laws applicable in French Polynesia.

Any dispute arising from or in connection with these conditions shall be subject to the jurisdiction of the Tribunal Mixte de Commerce de Papeete-Tahiti in French Polynesia or any other competent jurisdiction requested by Tahiti Nui Helicopters.
